E-2 Visa
IThe E2 treaty investor visa is a nonimmigrant, treaty-based option for foreign entrepreneurs seeking to establish and manage a business in the United States. Commonly referred to as E2 investor visa, it allows nationals of treaty countries to live and work in the U.S. while they actively direct and develop the enterprise
What Is an E-2 Visa?
The E-2 Investor Visa is a nonimmigrant visa classification that allows nationals of treaty countries to live and work in the United States by investing substantial capital in a legitimate U.S. business. To qualify, the investor must either have already invested—or be actively in the process of investing—and must have the authority to develop and direct the enterprise.
Authorized under INA § 101(a)(15)(E)(ii), the E-2 visa is designed to encourage trade and investment between the United States and countries that maintain a qualifying treaty of commerce and navigation with the U.S.
Although the E-2 visa does not directly lead to permanent residence, it can be renewed indefinitely, provided the business remains operational and the investor continues to meet all eligibility requirements. Visa validity periods and renewal terms vary based on the reciprocity agreement between the United States and the investor’s country of nationality.
At Bridgewood & Co., we guide investors through every stage of the E-2 process—from business structuring to visa approval—ensuring both immigration compliance and long-term commercial viability.

E-2 Visa USA for Employees of a Treaty Enterprise
While the E-2 visa is commonly associated with individual investors, U.S. immigration law also allows treaty enterprises to employ key foreign personnel who are essential to the success of the U.S. business. This provision enables E-2 companies to bring in executives, managers, supervisors, and employees with specialized or essential skills necessary to develop and operate the enterprise in the United States.
At Bridgewood & Co., we assist treaty enterprises in securing E-2 visas for qualifying employees whose roles are critical to the company’s U.S. operations.
Family Benefits of the E-2 Visa
The E-2 Visa USA is one of the most family-friendly business visas available under U.S. immigration law. It allows qualifying E-2 investors to bring their spouse and unmarried children under the age of 21 to live with them in the United States for the duration of their E-2 status.
At Bridgewood & Co., we help families fully understand and maximize the benefits available to E-2 dependents while ensuring continued compliance with U.S. immigration regulations.
